Welcome to southarknotary.com. These Terms and Conditions govern mobile notary appointments, website usage, and professional interactions provided by South Arkansas Notary. By requesting an appointment or using our services, you agree to these terms.

1. Statutory Non-Attorney Notice (Mandatory Arkansas Disclaimer)

South Arkansas Notary and its commissioned notary public ARE NOT ATTORNEYS LICENSED TO PRACTICE LAW IN THE STATE OF ARKANSAS AND MAY NOT GIVE LEGAL ADVICE OR ACCEPT FEES FOR LEGAL ADVICE.

We do not draft legal documents, interpret document provisions, or advise you regarding legal rights, duties, or notarial certificate selection. If you have questions regarding legal implications or document choices, please consult a licensed attorney or the receiving agency.

2. Identification & Personal Appearance Requirements

In accordance with Arkansas notary law, every document signer must be physically present at the appointment and provide a current, unexpired, government-issued photo identification (such as an Arkansas Driver’s License, State ID, U.S. Passport, or Military ID).

We cannot accept expired identification, photocopies of ID, or digital photos of IDs on mobile devices.

3. Appointment Scheduling & Dispatch

Online appointment submissions are requests subject to confirmation. A binding appointment is established once we confirm availability, meeting location, and the agreed distance travel fee via telephone, text, or email.

4. Travel Fees & Mileage Policy

Because our services are mobile, travel fees are calculated based on round-trip distance from our dispatch base in Fordyce, Arkansas to your designated meeting location. All travel fees and statutory notarial act fees are disclosed and agreed upon prior to dispatch.

5. Cancellations & Rescheduling

If you need to reschedule or cancel an appointment, please notify us at least two (2) hours prior to the scheduled time by calling or texting (501) 444-2703. If a notary has already departed for your location prior to cancellation, travel fees may apply.

6. Lawful Refusal of Service

By law, an Arkansas Notary Public must refuse notarization if:

  • The signer is not physically present before the notary.
  • The signer cannot provide satisfactory unexpired government-issued photo identification.
  • The signer appears disoriented, intoxicated, or unable to understand the document being signed.
  • The signer appears to be under duress or coercion.
  • The document is incomplete or contains blank spaces that could be filled in after signing.

7. Governing Law

These terms and all notarial acts performed are governed exclusively by the laws of the State of Arkansas and regulations issued by the Arkansas Secretary of State.
